Marketing Practices of Pharma Companies to Be Monitored By the Committee Established By Center

The government has constituted a high-level committee on the recommendation of Union Minister of Health and Family Welfare, Chemicals and Fertilizers, Dr. Mansukh Mandaviya, to hammer out a legal mechanism to address the issue of pharmaceutical companies giving inducements for promoting their drugs and products. On September 12, a government-issued office memorandum stated that the department of pharmaceuticals has come up with its code of ethics, the UCPMP, for pharma companies, which has been in effect since January 1, 2015, and has been adopted by all the major pharmaceutical associations. However, the office memorandum stated that the code is not enforceable under any law or statute of the government.

 

On the other hand, the Indian Medical Council (Professional Conduct, Etiquette, and Ethics) Regulations, 2002, explain the relationship between healthcare professionals and pharmaceutical companies. The memorandum also stated that the regulation prohibited physicians and medical practitioners from committing such acts which are "unethical" in nature and laid down the manner of enforcement in case complaints about the violation of these regulations were received.

 

The five-member committee is chaired by Dr. VK Paul, NITI Aayog member(health). The other members include Dr. S. Aparna, secretary of the department of pharmaceuticals; Dr. Rajesh Bhushan, Union health secretary; and Mr. Nitin Gupta, Central Board of Direct Taxes(CBDT) chairman; and a joint secretary (policy) from the department of pharmaceuticals as member secretary. The committee has been tasked with assessing the stakeholder departments′ policies on pharmaceutical marketing practices and how well they are carried out. It will also "explore the related concerns on the necessity of a legally enforceable system for regulating marketing tactics, including a review of practices around the world," and make a recommendation within 90 days.
